These Terms of Service (“Terms”) govern the use of the Tap Aruba platform, dashboards, NFC tags, QR codes, and related services (the “Services”) by a business or organization (“Client”, “you”). By using the Services, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorized to do so.
The Services
Tap Aruba provides a platform that turns a tap or scan into a digital experience — such as ordering, marketing links, event check-in, and visitor analytics — configured for each Client by Tap Aruba, along with dashboards to manage and view that activity. Available features depend on what has been set up for your account.
Accounts
- You are responsible for the information in your account and for keeping your login credentials secure.
- You are responsible for activity that happens under your account, including by your staff.
- You must notify us promptly of any unauthorized use of your account.
Acceptable use
You agree not to:
- Use the Services for unlawful, harmful, deceptive, or abusive purposes.
- Upload content that infringes others’ rights or violates applicable law.
- Attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the Services or other Clients’ data.
- Misuse Visitor information collected through your experiences.
Your content and data
You retain ownership of the content and business data you provide or generate through the Services (such as menus, links, guest lists, orders, and analytics for your business). You grant Tap Aruba the limited rights needed to host, process, and display that content in order to operate the Services for you. You are responsible for ensuring you have the right to use the content you provide and for handling Visitor information collected through your experiences in line with our Privacy Policy and applicable law.
NFC tags and physical materials
Where Tap Aruba supplies or programs NFC tags or QR codes, they are provided to point Visitors to the experiences set up for your account. A tag’s destination can be reassigned or disabled through the platform. Tags remain associated with the Services and should not be repurposed outside of them.
Fees and payment
Fees for the Services are arranged directly between you and Tap Aruba. At this time, payments are handled in person or by direct arrangement. We will give you reasonable notice of any change to fees that applies to your account.
Availability
We work to keep the Services available and reliable, but they are provided on an “as is” and “as available” basis. We may update, change, or temporarily suspend features to maintain, improve, or secure the Services.
Suspension and termination
We may suspend or terminate access if these Terms are violated or to protect the Services or other users. You may stop using the Services at any time and request that your account be closed. On termination, your right to use the Services ends; we will handle your data as described in the Privacy Policy.
Disclaimers and limitation of liability
To the maximum extent permitted by law, Tap Aruba is not liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the Services. The Services are not a payment processor and do not handle card payments.
Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, notify you of material changes. Continued use of the Services after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Aruba, without regard to conflict-of-law principles.
